UNAUTHORIZED BANK TRANSFERS

Banks should be safe. But increasingly, criminals and hackers are figuring out ways to access consumer checking accounts and transfer money out - never to be seen again. Federal law, through the Electronic Funds Transfer Act (EFTA), often entitles you to receive most of your money back if it was deducted from your account without your authorization. Unsurprisingly, banks often refuse to reimburse consumers as the EFTA requires.

THE RULES

The EFTA covers unauthorized electronic funds transfers (EFTs), but it does not cover wire transfers

You have a right to be reimbursed for unauthorized EFTs (less $50 or $500, depending on the circumstances)

Banks are required to conduct meaningful investigations into complaints of unauthorized EFTs

GETTING LEGAL HELP

The EFTA has a short, one-year statute of limitations, so when you have been the victim of some sort of fraudulent transactions, it is important you speak to an attorney immediately.

Our office offers free consultations.

We can often fight debt collectors on a contingency basis - meaning we only get paid if you do.
